{"id":2795,"date":"2026-03-30T14:42:18","date_gmt":"2026-03-30T12:42:18","guid":{"rendered":"https:\/\/lodgesdescapssauvages.com\/conditions-generales-de-vente\/"},"modified":"2026-05-21T12:22:16","modified_gmt":"2026-05-21T10:22:16","slug":"conditions-generales-de-vente","status":"publish","type":"page","link":"https:\/\/lodgesdescapssauvages.com\/en\/conditions-generales-de-vente\/","title":{"rendered":"General Terms and Conditions of Sale"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The general terms and conditions apply between the Lodges des Caps Sauvages, EURL Ti Mao, a company registered with the RCS of Saint-Brieuc under number 943 955 633, whose registered office is located at 22430 ERQUY, represented by its manager on the one hand, and the tenant on the other.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prior to any booking confirmation, these general terms and conditions are communicated to the tenant, who acknowledges having taken note of them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every traveler&#8217;s stay is preceded by a printable written reservation, by email, etc., along with the contract. To validate the accommodation reservation, the Tenant must return the signed rental agreement to Lodges des Caps Sauvages or sign it electronically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The booking confirmation reflects the reservation period, the accommodation reserved by the tenant and its essential features, the number of travelers for whom the booking is made, the price of the stay for the part that can be calculated, and the specific terms related to any potential refund conditions for the stay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. DEFINITIONS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the sake of clarity and simplification of certain terms used in these conditions, the following is hereby defined: any accommodation offered by the Caps Sauvages Lodges shall be referred to as \u201caccommodation\u201d or \u201ccottage.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any person making a reservation and any occupant thereof shall be referred to as the &#8220;tenant.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>It has been agreed and determined as follows:<\/strong><br>Lodges des Caps Sauvages rent, for the duration indicated in the contract, the accommodations designated, furnished, and equipped as specified in the contract and in the descriptive inventory attached hereto, to the Tenant who accepts them under the following conditions. It has been agreed between the parties that Lodges des Caps Sauvages rent to the Tenant the accommodation as described in the contract and in the inventory attached to the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. DESTINATION OF THE DWELLING<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The accommodations are rented exclusively for residential use as a seasonal tourist residence, meaning temporary. They do not constitute the traveler&#8217;s primary or even secondary residence, and no commercial, artisanal, or professional activities may be conducted there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a result, the contract shall be governed by the provisions of the Civil Code as well as by the conditions set forth herein.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. DURATION, DESCRIPTION AND PRICE OF THE STAY<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Duration<\/strong>: The Caps Sauvages Lodges rent the accommodation to the Tenant for the period specified in the contract. The stay is non-renewable. The rental is for a fixed term that will begin on the agreed-upon date at 4:00 PM. The Tenant expressly agrees to have fully vacated the accommodation by the check-out (departure) date at the latest by 10:00 AM and to return the keys in person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Beyond this term, the Tenant shall, unless expressly agreed by the Lodges des Caps Sauvages, forfeit all rights to occupy the premises.<br>The initial lease and any extended lease may not extend the rental period beyond a maximum of ninety days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the day before check-in (arrival), the Caps Sauvages Lodges will provide the tenant with instructions for entering the accommodation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Description:<\/strong> The accommodation and its features are specified in the contract<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Price of the stay<\/strong>: The price of the stay and payment terms are specified as part of the booking process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The price of the stay is payable no later than one month before arrival.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rental is granted and accepted for the total price mentioned at the end of the contract, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the price of the occupation of the premises<\/li>\n\n\n\n<li>the bath linens<\/li>\n\n\n\n<li>bed linen<\/li>\n\n\n\n<li>shared access to the indoor heated pool<\/li>\n\n\n\n<li>shared access to the sauna and leisure facilities<\/li>\n\n\n\n<li>the insurance of rental risks<\/li>\n\n\n\n<li>the consumption of electricity and heating<\/li>\n\n\n\n<li>the consumption of cold and hot water during the term of the Lease<\/li>\n\n\n\n<li>the tourist tax<\/li>\n\n\n\n<li>Internet<\/li>\n\n\n\n<li>access to the private Nordic bath<\/li>\n\n\n\n<li>cleaning<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The tourist tax is collected by the Caps Sauvages Lodges on behalf of Lamballe Terre &amp; Mer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Tenant shall pay these charges in addition to the rent for the duration of their stay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The amount of the excluded charges will be paid upon booking, at the latest one month before arrival.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, the Tenant shall directly settle with service providers all expenses not included in the aforementioned list, which they have incurred on their own behalf, so that the Lodges des Caps Sauvages are never troubled or pursued in this regard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the price of the stay was not fully paid by the end of the stay, then this price would be increased by 15% as a penalty clause, eight days after the sending, by the Lodges des Caps Sauvages, of a registered letter with acknowledgment of receipt, requesting payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. CANCELLATION OF THE STAY<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is agreed that in the event of cancellation\/withdrawal:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>of the Tenant:\n<ul class=\"wp-block-list\">\n<li>more than 30 days before the lease takes effect, the tenant forfeits the deposit paid,<\/li>\n\n\n\n<li>Unless it is less than 30 days before the lease takes effect, the tenant will additionally pay the difference between the deposit amount and the equivalent of the total rent, as a penalty clause.<\/li>\n\n\n\n<li>If the traveler decides to leave before the date specified in the booking, the unused nights at the Lodges des Caps Sauvages will not be refunded.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>of the Lessor:\n<ul class=\"wp-block-list\">\n<li>within seven days of the withdrawal, it is required to pay the tenant double the deposit.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Cancellation insurance was offered to the tenant at the time of booking with our partner insurer by clicking on the following link: &#8212;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. DEPOSIT OF GUARANTEE<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A deposit is required upon entry to cover any potential damage to the furnishings in the accommodation, any missing items, and to compensate for various consumption charges not included in the stay price. This deposit amounts to \u20ac300 and is not collected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, a sum of up to \u20ac150 may be deducted from the security deposit for the thorough cleaning of the premises.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The security deposit will be refunded no later than 20 days after departure, provided that the checkout inspection reveals no issues or damage to the property. The refund of the security deposit will be processed within the same timeframe, less any amounts owed by the traveler for utility charges or minor repairs, if applicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the amount paid as a guarantee proves to be insufficient, the Tenant shall pay any additional amount upon presentation of supporting documents by the Landlord, within 4 days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For all lodges, any lost, broken, damaged, or deteriorated item must be replaced or reimbursed to Lodges des Caps Sauvages at its replacement value by the traveler who agrees to do so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The return of keys to the Caps Sauvages Lodges at the end of the stay does not constitute a waiver by the Caps Sauvages Lodges of any compensation for rental repairs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6. CAPACITY<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under no circumstances shall the accommodation be occupied by more people than those specified in the contract, unless prior agreement is obtained from the Lodges des Caps Sauvages. In such cases, the Lodges des Caps Sauvages may demand an additional rent, refuse entry to the premises, or terminate the contract, which will be considered terminated at the tenant&#8217;s fault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7. INSURANCE<br>The traveler is responsible for all damages occurring in the accommodation, including those resulting from their negligence, as well as in the event of a fire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He is also responsible for any damage and loss occurring due to his actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The traveler is therefore advised to verify that their insurance policy for their primary residence includes a &#8220;vacation&#8221; and &#8220;off-premises personal property&#8221; clause, and if their policy does not include these, to request an extension or to purchase one for the duration of their stay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a result, the Caps Sauvages Lodges disclaim any liability for any recourse that the traveler&#8217;s insurance company may pursue in the event of a claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>8. TENANT&#8217;S OBLIGATIONS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Tenant is subject to the following main obligations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To take the Premises in the condition they will be in at the time of key handover and as described in the inventory report, along with the furnishings, equipment, materials, and items contained therein as described in the inventory list;<\/li>\n\n\n\n<li>To pay the rent and charges according to the agreed schedule;<\/li>\n\n\n\n<li>To use the premises peacefully in accordance with their contractual destination;<\/li>\n\n\n\n<li>To be liable for any damage or loss that may occur during the term of the Lease in the premises over which he has exclusive use, unless he proves that such damage or loss resulted from an act of God, the fault of the Lessor, or the act of a third party whom he did not admit into the dwelling;<\/li>\n\n\n\n<li>To use the furniture, equipment, materials, and items furnishing the premises, in accordance with their intended purpose, and to leave them in the locations where they are found. It is strictly prohibited to transport them outside the rented premises.<\/li>\n\n\n\n<li>It is specified that the furniture, equipment, materials, and objects shall only suffer depreciation resulting from normal use for which they are intended.<\/li>\n\n\n\n<li>Furniture, equipment, materials, and items that are missing, damaged, or rendered out of service for reasons other than normal wear and tear must either be replaced with identical items, subject to the Lessor&#8217;s approval, or compensated at the cost of replacing them with identical items.<\/li>\n\n\n\n<li>Not to modify in any way the premises, nor the arrangement of the furniture;<\/li>\n\n\n\n<li>To refrain from throwing into the pipes any objects or substances likely to clog them. The Tenant shall be liable for the costs incurred for the repair and restoration of these pipes;<\/li>\n\n\n\n<li>To allow the execution in the Premises of works whose urgency and necessity become apparent during the course of the lease, without being entitled to any compensation;<\/li>\n\n\n\n<li>Not to underlet or assign its rights under this agreement without the express and written consent of the Lessor, under penalty of termination;<\/li>\n\n\n\n<li>To occupy the Premises and behave as a good father of a family. He shall not store any furniture therein. He shall not cause any disturbance to the neighborhood;<\/li>\n\n\n\n<li>Not to allow the premises to be occupied by a number of people exceeding the maximum number indicated;<\/li>\n\n\n\n<li>To report to the Lessor without delay any malfunction or deterioration, regardless of its cause.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"text-transform:uppercase\"><strong>9. OBLIGATIONS OF THE CAPS SAUVAGES LODGES<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Caps Sauvages Lodges are subject to the following main obligations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To deliver to the Tenant the rented accommodation, along with its furnishings, equipment, materials, and items, in accordance with the descriptive state provided by the Landlord;<\/li>\n\n\n\n<li>To provide the Tenant with a dwelling in good condition of use and repair, as well as the equipment mentioned in the Lease, in good working order;<\/li>\n\n\n\n<li>To ensure the Tenant&#8217;s peaceful enjoyment of the premises for the entire duration of this agreement;<\/li>\n\n\n\n<li>To install and maintain at least one standardized smoke detector in the dwelling.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">10. LIABILITY<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The traveler waives any recourse for liability or claims against the Caps Sauvages Lodges due to:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1\u00b0) theft, attempted theft, any criminal act, or any assault that the traveler may suffer in the rented premises; the traveler expressly waives the benefit of Article 1719, paragraph 3 of the Civil Code, as Domaine du Grenier assumes no obligation of surveillance;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2\u00b0) irregularities or malfunctions in the water, electricity, telephone, air conditioning, generator sets, all computer systems, and collective services and common equipment elements of the rented property;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3\u00b0) damage caused to the premises, rented and\/or to all movable items located therein as a result of leaks, seepage, dampness, or other circumstances;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4\u00b0) of conduct causing harm to other occupants on the site;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5\u00b0) Late arrival of the traveler at the premises, due in particular to difficulties with transportation;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6\u00b0) Nuisances, particularly noise, likely to occur from outside the dwelling;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7\u00b0) accidents occurring in the rented premises or due to the rented premises during the lease term, regardless of the cause;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8) of malfunction of the Internet or cable television, or in case of incompatibility between the accommodation&#8217;s equipment and the traveler&#8217;s equipment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9) Services provided by external service providers.<br>The traveler is particularly liable for damages resulting from their negligence, as well as in cases of fire, water damage, explosions, affecting neighboring dwellings and their occupants.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11. HOUSEKEEPING FEES<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regarding the cottages, if the cleaning option has not been selected, the cleaning must be done by the traveler. However, if the cleaning is not properly done and the traveler has not selected the cleaning option, then the cleaning will be charged to the traveler between 70 and 150 euros depending on the number of cleaning hours required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12. MISCELLANEOUS<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 NON-SMOKING HOUSE: The entire deposit will be retained if the apartment smells of cigarette smoke or other substances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 Animals not allowed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 Unauthorized parties and events.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 The Tenant undertakes to respect the tranquility of the neighborhood, particularly between 10:00 PM and 8:00 AM.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13. ELECTION OF DOMICILE<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the purposes of these terms, the parties elect domicile at their respective addresses provided during the booking process. The parties agree that the competent court shall be that of the jurisdiction in which the rented premises are located.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong> <\/strong>14. RESCINDING CLAUSE<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of non-compliance with any of the clauses of these general terms and conditions or the conditions set out in the context of the contract, or of unauthorized occupation beyond the duration specified in the reservation and eight days after a formal notice to pay or perform that has remained ineffective, the lease agreement shall be automatically terminated, at the discretion of the Lodges des Caps Sauvages, and without judicial proceedings. If the traveler refuses to vacate the premises, an interim order issued by the president of the judicial court shall suffice to enforce eviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15. PENALTY CLAUSE<\/strong><br>Without prejudice to the possible enforcement of the termination clause and the claim for damages, pursuant to Article 1231-5 of the Civil Code relating to penalty clauses, the parties agree that failure to pay the rent or charges will result in a 15% surcharge on the amounts due.<br>This penalty clause shall take effect in the event of the tenant&#8217;s inaction for more than seven days following the landlord&#8217;s sending of a formal notice by registered letter with acknowledgment of receipt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>16.
